eiusdem...facerent: = "risk" (lit., they should make the risk of the same money"), that is, the sum that had to be deposited in order to file an appeal with the princeps and was forfeited if the the appeal failed; by a decree, the same now had to be deposited to file an appeal w. the senate; "facerent" in the subordinate cl. in historic sequence replaces "facient" or "faciant," "let them make."
